Texas Question: Do You Need A License To Sell Flowers?

Hello everyone! Man it is freezing down here in Houston! Its sad that 33 degrees is freezing huh?
Okay, I make gumpaste flowers, which no one eats because they're too hard. I also make fondant/gumpaste flowers which no one eats, but could if they were desperate. j/jk I'm also really good at making clay figurines and will eventually branch out into making cake toppers using the gumpaste too.
I want to start selling them on the internet, but do you have to have a license for that? I called Harris county and explained it to them too, and they just said for anything that is food or edible. But the woman who answered was stumped too, she thought that I wouldn't need one, but told me to call back.
Does anyone know?

I think you would be safe to assume (dangerous word) that as long as you clearly mark them as 'decoration-do not eat' you would be safe selling them.

Keep in mind, the flowers are very fragile, and difficult to ship unbroken.

If you plan to ship them, you need to determine what your policy will be for broken goods. It could be a problem for you.

You might look at some of the other sites that sell GP flowers.

FWIW, I asked my county health dept. rep about what I COULD make in my licensed kitchen and what I could make ahead of time at home. I specifically asked about gumpaste flowers, and she was very adamant that ANYTHING that touched the cake would have to prepared in a licensed facility. I thought it was the stupidest thing I'd ever heard.

I think if you sell them, you should not even disclose that they are made out of an 'edible' substance. Unfortunately in Texas, the rules are very strict about this kind of thing.

thank ya'll both! I think as long as I put that they are for Decorative Purposes only like JoAnn suggested, I should be okay. They have the wires on them, so that should help with that aspect.
I want to move out of Texas!!!!!
