Hello everyone, this is Mr Sprinkles the "inventor" not of the container, but of the idea of puting cake inside of a container designed for ice cream. Yes, the patent is pending. That means that you can make them to sell if you want. However you are put on notice that if the patent is granted you will have to stop selling. If you make them for your own use you will never have anything to worry about.
If the patent is not granted you can continue making them to sell with no problem. The latest news is that the patent was rejected, but I have appealed and will not know the outcome for at least a few months. I am hopeful that the patent office will change their minds. If they don't, that will be great for everyone that is making them now to sell.
However, please note that I do have the exclusive ownership of the national trade mark "cakeshooter" or "cakeshooters". So if you are selling them, you can call them anything else except cakeshooters. If you call them cakeshooters you are in violation of my trademark, so please stop.

how exactly do you eat a cake push pop. Seems really messy without a fork. Do you eat one layer at a time? I guess I will have to find one to buy. Looks even more tedious to make than cake pops.

Ok, I'm going to apply for a patent too. Mine is for putting cake batter in these little cups that have ridges on them. Cup+cake...cupcake! No one steal my idea! Feel free to make them and sell them but if my patent goes through you will have to pay me royalties for that.

I'm with you on no bananas in public! Also, nobody could pay me to eat a tube of cake, that's just gross.
I'm going to patent a metal ring with a metal bottom...I call it a "cake pan." That will compete with the cup+cake patent.

I am going to patent a tightly rolled piece of paper, shaped like a small twig and a plastic version as well, so you fools will have to pay me to put your cake globs and Cake Chuters on them! And candy.

I have given this a lot more thought and I am going to Patent Cake Sh*t Chuters®.There will be a baby version that is chunks of yellow cake in Tapioca pudding®, a toddler version that is chunks of rainbow cake in chocolate pudding®, for remembering when they ate the crayons, then the standard one with chocolate cake and chocolate pudding and whole peanuts with caramel sauce®. Bunny Balls, with a bunch of tiny rolled chocolate covered cake balls bouncing around in the container®. And then the health food one, a long cake dough snake, rolled in granola and coiled in the tube®.
