Neighborhood Rules?

I just found out after i figured out how a plan to get a lisenced kitchen that my neighborhood has rules! The rule is that a small bussiness can't be put up in my house because of my neighborhood for some reason. Its ridiculous! Any way to get around this?? icon_cry.gif

I would find out what the rules are and why. If it is because of traffic, you can offer to deliver all cakes. Try and see if there is a commitee and if they have rules/covenants. Though most neighborhoods have rules, they will often make exceptions depending on the business and if explanations are given.

Contact your city. There is usually a special circumstances petition and process that you can go through. That might help.

A lot of neighborhoods have those rules. First, is it that you are unable to run a business our of your home or is it that it can't be a noticeable business? Know what I mean? Like, if you have a sign outside advertising the business. I don't see how they will be able to tell if you are running a business out of your home if it's not advertised with a sign. We had those same restrictions and that was how it was worded. Check into it. Even if people are coming to your home to pick up your cakes -- how noticeable can that be???

My homeowners association has a rule like that. I do operate a business out of my home (not food related) and I have clients coming to my home office regularly. When I looked into it, it turned out that as long as I have fewer than X number of people coming and going within a 24 hour period and my direct neighbors signed something that they didn't mind, it's OK. I also don't "hang a shingle"

I'm definately going to check out if i can get around this rule. Maybe i'll suggest the X number of people thing if i can. I don't think i'll have more than 1 person a day. Lol! Thanks everyone!! icon_biggrin.gif

If you check the rules you may find that your plan will be okay. It's usually a rule made to protect the amount of traffic coming and going or signs in the yard or equipment sitting out in backyard.

I think most neighborhoods have zoning laws; I think as long as you don't have traffic, you are going to somehow get around this. I'd check into it. If this were 100% true, then people wouldn't be able to do all sorts of home businesses, such as computer work, etc. I would definitely consult the city, and then a lawyer, especially if this is your livelyhood.

vitade i thnk you hit the mark on exactly why they made the rule. My mom seems to think that there's no exception to the rule ,but we'll see!!

That's true ellepel. I guess there are exception(except i don't know anyone in my neighborhood that does there own business at home.)
But i'll check this out ASAP!

It's worth finding out. True though about also having to find out about local ordiances. Your town, county or state will also have their own requirements. I don't know if the neighborhood rules, rule over those laws or vice versa.

In my neighborhood doesn't have an association but I still have to follow city zoning laws that say no more than 3 cars in a 24-hr period and no signage. Breaking the rules can result in fines.

My mother unfortunately has had a lot of dealings with the civic (neighborhood) association. They have rules that you basically have legally agreed to just by buying your house. They can't fine you but they can sue. Find out when their next meeting is and be up front with them. It might help if you talk to your neighbors ahead of time and let the assoc. no they don't have a problem with it.
