WHo Does THIS?!? Seriously!! - Page 3

I'd forgotten all about it until this thread.

 

In February, I emailed them "You are using MY photo of the Arsenal football top cake. Please remove it immediately."

 

And then I got an email back from them "sorry who is this could you ring our shop at xxxxxxx"

 

Erm... no!  I have no intention of a) phoning long distance b) getting into a slanging match on the phone.  I simply want them to remove my picture! icon_sad.gif

I think you need to e-mail back with some "lawyer speak" in there, and tell them you will be contacting their ISP.  Don't give up!

I was browsing Living Social one day and saw that a caker in my area had a deal, so of course I wanted to check out my competition.  I took a look at her facebook page and low and behold, she had some of her photos, but the majority of them were professional photos that were clearly not hers, especially the ones of cake pops she took directly from Bakerella!  Disgusting!  I called her out on it and notified Bakerella and the Pink Cake Box that she was using their photos.  Apparently non of them care too much because they are still on her page and she's selling them as if they are her own.  I work hard at my craft and don't take short cuts.  I have no use for stupid cheaters!

You can use the "letter to host" template here to file a DMCA takedown notice with their service provider:

I noticed the awesome spelling too!  lol...

 

 

This just disgusts me! I don't understand posting pictures of someone else's work and passing it off as your own! It's just plain wrong and makes me so mad! It's not that I don't want anyone looking at my pics... I just don't want someone else benefitting from the hours of time that went into making the cake in question and the years of practice I have put in to be able to do the cake.  If you don't have time to build your own portfolio then don't sell cakes.  PERIOD! If I was looking for someone to make my wedding cake and found out that the person I booked had shown me a bunch of cakes she did not do herself(himself) I would be so mad!

If you have a smartphone, you can download one of the tons of free watermarking apps available. I have two on my iPhone (trying to see which I like best): eZ Watermark and iWaterFree. It takes all of one minute to add a watermark to your photo. I'm a hobby baker and I upload photos on Pinterest and a couple baking/cooking Facebook groups. I always make sure to watermark my shots because my work is pretty neat and I don't want others to steal them.

That's too cool! I didn't realize there was a smart phone app for that! Silly me... there's an app for just about everything these days.   Ever since this whole thing it has made me realize the importance of the watermark! I have started doing that to my cake pics too.

You should always take a " few extra pictures " of your cakes from a different angle when you post " ONE ".  That way you have more of a leg to stand if you are required to provide further proof a picture is yours.  You will have angles of the cake the thief clearly won't be able to provide. Of course you don't send those to the would thief but you use them in case they start a counter-DMCA. Most won't bother.

 

And don't bother talking to the thieves, hit them straight with the ISP or the website hosting the pictures like facebook.

Dear Ann,
I was interested in your Arsenal shirt cake, but I noticed that it looks like its of much better quality than all the rest of your cakes. Does the decorator who made that cake usually work for you, or will my cake be made by the person who made all the other, less professional looking cakes?

As you can see from the pics I've posted for a while now, I watermark right through the middle of the cakes!!!!!

There was a bakery who was using another bakery's pictures. They would slice off a tier, cake topper, or remove a flower but you could still tell that it wasn't theirs. They even went so far as putting a watermark on the cakes. I notified the original owner and she thanked me but said that she had decided a long time ago that chasing down every person that steals her work would be too time consuming. To each his own.

 

A local bakery did use a picture of a cupcake that was made by Glory from Glorious Treats. I told the followers that they could make the cupcakes from home since Glory was so nice that she posted a recipe and tutorial. They took that post down lol.

Thanks for the notification.  We do care, but honestly it's hard to keep up :)  Unfortunately these issues are much more common that we'd like and we are always playing catch-up.  But I certainly always appreciate the notifications - the cake community is great at looking out for each other.
