I don't think that is the reason people buy online. Generally the prices online are just significatly cheaper even before you factor in sales tax due to warehouses have alot less overhead as opposed to a store front. Not that much different then home bakers being able to charge less because they don't have to factor in the overhead of the store front.

I also don't live in California anymore but grew up there and my family is there so still spend alot of time there. None of us have ever even heard we were suppose to report and send in use taxes.

pbuder, I also don't think avoiding sales tax is the reason people buy online most of the time. Rather it is an unintended consequence. Nevertheless, I do hear shopkeepers talking about the fact that not having to collect sales tax does give online merchants an edge.

I have known for a long time that Californians are supposed to declare and pay use tax. I also know virtually nobody does. I have heard more than once on the news recently that this is one of the things legislators are looking at in order to recoup what they construe as tax losses.

I'm probably one of the few people in Virginia who actually do pay a sales tax on my state income tax for things that I buy online. VA is going to start make companies collect sales tax for online sales now, so they'll probably do away with that. I also agree that avoiding the sales tax isn't the reason that most people buy things online. I buy almost all of my cake stuff online becasue there's only one cake supply shop around here and they stink.

Update: got a call from the State, they told me that if I deliver the cake outside of my city and don't solicit upon delivery (not certain what that means), I do not collect nor pay any city's sales tax icon_eek.gif
When asked to have that in writing, was told it's in the code, when ask where exactly so I can read and print it out for my use, was told they need to call me back. Who knew this is sooooooo complicated icon_cry.gif

Would that mean that you just can't get final payments when you deliver
the cake? Because then you're not making any financial deals in they city?

That was always a given. I don't collect any money at deliveries, final payments are always made weeks in advance. When I asked for an example, they said "well, like, uhmmm, maybe not leave any business cards on the cake table..."

Soliciting is advertising/requesting future business. IE, the example of leaving business cards or brochures or such or probably even discussing your business with any of the guests even if they approach you.
