Fl Cottage Food Law Question--Frosting

Looking to start selling cupcakes out of home. Seeing lots of FL people doing this under the FL Cottage Food Law but have a question--law says the following is not allowed--

"Bakery goods which require any type of refrigeration such as cream, custard or meringue pies and cakes or pastries with cream cheese icings or filling"

So that means I can't sell cupcakes with cream cheese frosting or whipped cream frosting or even buttercream, right?

So is everyone just breaking the new law, or am I missing something?

You can make shortening based buttercream which does not need refrigeration and just add butter flavored extract to give it the buttery flavor.

I do a half n half (1 stick butter n 1/2 stick crisco) buttercream and it is shelf stable IMO. I have left it out and it has never "gone bad" or caused any problems.

Frosting as described above IS shelf stable. The only time I put mine in the fridge or freezer is if I have made too much and I want to keep it for future use beyond 2-3 weeks.
