Tiffany Says "ok" To Tiffany Box Cakes

Hi. I am the OP of the thread on copyright infringement in cake. I posted that I would update you guys on anything I found out, but the thread is locked. LOL, does that mean I'm in trouble? I have contacted several companies whose products/images are often replicated in cake. I am still awaiting replies from most but here is what Tiffany said in an email to me:

I received a response from the appropriate department in regards to your question. It is completely legal to create the Tiffany blue box cakes. The color Tiffany blue is copy righted, but if you are using a similar color and not the exact color, it is okay to create the cakes. You are not however allowed to use the Tiffany hallmark to decorate the cakes. I hope this answers your question and puts your mind at ease about being allowed to create the cakes. It could take awhile, but I have asked for the official policies of Louis Vuitton and Coach. I got a reply, but not an official statement, from Louis Vuitton- and they said there are no licensing opportunities available. That means don't do L.V purse cakes! I had a customer ask for one and I said I would do a purse cake, but not L.V. ~Rachel

denotatively --- it isn't
connotatively -- it is.
while it might not be an exact duplicate, it will create the impression of the original even so.
even as red, white & blue bunting isn't a flag, but conjures up images of flags and patriotism.
the name of the color can be copyrighted and then tied to a service mark or trademark as part of what makes that mark unique.

Well to be fair they are not "allowing" anything only explaining why it is you can make a "knock off" Tiffany box and not have to worry about infringing their copyrights or trademarks. Basically the reply is providing the same explanation for why it is legal to make designer knock offs. A person can make a knock off of a Coach bag (an actual bag not cake) but cannot use the Coach trademarks (which is why you will see them offset the C or use GG to give the impression of the trademark) and sell is as a "Coach replica." You are legally able to copy the look. Of course this is because fashion (and evidently Tiffany boxes) does not have protections associate with images, written documents, etc.

My mom's a general manager for BK, and there blue is copyrighted. I had to do some painting at her store for her, and had to take a letter to the paint place they have the color stored with in order to get a can of it. I was laughing, I didnt think blue was that particular
