Provocraft just made certain that every professional will now be purchasing MTC or SCAL and forgoing additional cartridges. I had planned on buying numerous cartridges but now I'll just get similar images elsewhere and use MTC of SCAL. They actually saved me quite a bit of money. Thanks Provocraft!!
So, do I understand this correctly.....If I use cricut images on a cake I cannot sell it. It is only for personal use.

I just spoke with a CSR at HSN about copyright for the images used with cake cricut. She read through the information they have and it says it is to be used by professionals as well as beginners. There is nothing metioned about copyright rules.
On the HSN preview, they even mention making cakes decorated with cricut cake and being sold.
LOL, or even damask???? Seriously? How many YEARS have people been doing that on cakes? How can they copyright damask? I seriously don't think they can.

Okay, this is how I look at it. I purchased this from HSN. There was NO mention of any kind of copyright law on these cartridges, and even comments made about selling cakes that you've created with the cricut cake.
Since NONE of this information was provided when I purchased this equipment, I am not liable for any issue they have with me selling cakes I've used the cricut to HELP create.
Next thing you know they will want me to put some kind of note on the cakes... "created with Cricut Cake"!
Secondly, how in the world could they prove that you didn't hand cut that flower out instead of using the cricut? Seriously! I use stencils, cutters, and even hand cut some of my things. I guess my next word would be PROVE IT.
If they want to push the issue, I'll send the DAM* thing back! I've made a good living with the work I have been doing, won't hurt me to send it back.
I hate that it will hurt HSN... as I'm sure THEY were not notified of any kind of copyright on the cartridges.

She could not give the amount of the license fee because she said it had not been determined as of yet. This license thing will also include anyone who bought one of these in Canada. She said to keep checking cricut.com for more information.

Ummm.... Watch... this is what they're going to do . I bet they wait until your 30 days is up to return it to HSN and THEN they will come out with some crazy license fee. I'm thinking of cancelling my order.

Hummm, well this is really going to hurt them in the long run. There are going to be so many cartridges flooding ebay, that no one will NEED to purchase one at full price from the store.... hurting their sales of catridges for a long time. Okay, I think I'm going to keep my cricut cake, but put the cartridges on ebay and sell them... then I'll just purchase SCAL and be done with Cricut forever. They want to be like that..and not tell you this till after the fact, fine...but I feel like it will hurt them in the long run.
I just phoned the place where I ordered three of their cartridges, and of couse they are closed already, but I left a message saying i want to cancel my order on the three cartridges. I hope to hear from them tomorrow. I think Cricut will have alot of ticked off people ringing the phone off the hook for the next few days!
Not to get too techy but fonts and pictures from a lot of sources out there are also copywrite protected. All microsoft fonts and images, adobe photoshop images and fonts are also protected. You can't use them to make a profit. I see it all the time at craft shows and stuff..but they can come after you if they want. Just throwing that in there....
I don't see how they can do that. they made a product and copyright it so another cutting company can't copy the designs and sell them as their own, but this product is doing what it was designed to do. It is specifically made and marketed to cake makers, for use on cake.
How then can they after the fact of sale put a licensing limit on the product that is being used by the consumer for exactly what it was made for. Seems like a fancy way of charging twice for it. I don't think it will fly. I think they will be able to protect other companies from scavenging it, but not apply a licensing limiting the use of it.
Shoot if that were the case tons companies with products that are in use could do the same thing. Oh you can't use our rubber gloves for the purpose we designed them and the purpose you bought them for without purchasing the right to use them. That's what a license is the right to use it.

Look out maybe the carpentry world will be next. Dewalt will start making carpenters buy licensing to use their specialty bits and jigs. Maybe our pot and pan companies will start charging us licensing fees to use their products to.
I am definitely getting the SCAL program! I started thinking... what about people who may use the cartridges for gift tags, etc to put on an item they may sell? And its ironic that they don't have a determined price yet for the license fee. Sounds like something they have JUST come up with....
Think about it could say Kitchen aid, Agbay (fill in the blank the possibilities are limitless) put a licensing limit on their product and make you purchase it in order to use it as a tool (for the purpose it was designed and manufactured) in part of your business?

Well I think the major selling point for the Cricut Cake is it can cut meat so hooray for that!

Doesn't anyone on here have a patent/licensing attorney in their family? How legal is it to add an additional fee to something that has already been marketed and sold to professionals for their use? Is HSN going to send us a statement to sign that says "we agree not to use the Cricut Cake & cartridges to make a profit?" Give me a break!! Were they disappointed by sales? Or did they all of a sudden think of a way to make more $$$$$$$$??? What about all the professional decorators that received ones to trial? Have they used it to decorate and sell cakes? If so, I think that would set a precidence. I am only a hobby cake decorator - but I ordered mine Sunday night (Monday morning.)
I used to have a friend who was a patent/licensing attorney for major companies (including Microsoft) when a foreign company became privatized (I believe it was with Viet Nam or Hong Kong - don't remember.) Unfortunately, she is now in politics so I don't know if she could answer our questions.
This isn't new....many years ago when buying rubber stamps quite a few of the companies stated right in their paperwork that the artwork was copyrighted and was not to be used in any way to create items for sale....really frustrating. I sure don't see that as much anymore, maybe the manufacturers gave up on trying to police the farmer's markets, etc. for illegal merchandise!
Me, I think I'm going to tape the HSN demo and show that they say over and over again how you can "sell" the cakes for $$$$$$ "just go to your grocery store and order a fondant covered cake, add the gumpaste cut with the cricut and sell it for $$$". There was never a mention of copyright issues.
It will be so interesting to see how this evolves.
Glad I found this information. I had just called in my order to HSN for the cricut cake, and after reading these posts I have already canceled my order. Thanks for sharing everyone! I can't imagine how much the license fees are going to be! I'll just stick to my own ways for now! Was so excited that my husband agreed to let me order one now just disappointed!!!

M\\y husband is an attorney so I asked him about this when he got home tonight. He is not a patent attorney, so he can't say for certain, but he told me he thinks that they really can't license shapes. Characters, yes, but shapes, likely not. He's going to ask a patent attorney friend about it.
I think there is good reason why the licensing information is still listed with no details. I doubt PC even has it worked out yet.
I just checked out the SCAL program and its awesome so in actuality I am not canceling my order and wont need their license because i can use the SCAL program and wont need their cartridges. It still works out for me.
