Florida Business Owners, tax on baked goods or not?

I called Tallahassee and they said that baked goods are taxable but when I check it out on the website it says that baked goods are exempt.

Very close to opening in commercial kitchen space to made cakes and cookies that I deliver. The space does not have "eat in" space. Do I charge tax -- or not?

Who could I turn to that can answer these business questions?

When we were doing a similar thing out of our friend's kitchen, we didn't charge him tax because in that scenario, we were selling cheesecakes to him wholesale. He turned around and charged the tax to the customers. For cakes, cookies, and chocolates that we made at his place for others, we charged them tax and forwarded this off to the Department of Revenue.

If you have a good accounting system in place, it's easy. The Department of Revenue sends you a coupon booklet for the year. One copy you mail to them with payment; one copy you keep right in the booklet for your records. The coupon and payment are mailed out quarterly and are considered late by the 20th of the month following the quarter end.

I'm not a pro baker but I am a Florida consumer so not sure if this helps but if I buy donuts or pastry at the grocery store (no place to sit & eat) or the bakery, I pay sales tax so I would think that you have to charge tax.

So sorry, I was wrong. I looked at my grocery receipts & I don't pay sales tax on baked goods @ the grocery store but I do at the bakery. So I guess I was not helpful at all. With that said, I will go sit down & be quiet now. icon_redface.gif

I know if I buy baked goods to go at Panera's there is not tax, if I get them to eat there, I pay tax.
I know grammar, syntax and I can spell -- I just can't type!

I just opened my business in Tampa and when I spoke with the Dept of Rev. and asked if I needed to charge tax I was asked if they would be eating the cakes there. I said there are chairs and tables, however, they belong to the business that I am getting baking space from and my cakes will be taken from and not eaten there. I was told that I would not charge tax nor would I pay any. I hope this will help you.
