Would You Have Stopped Payment? (Vent)

Apparently, the MOB felt the cake was a big disappointment. I accepted her final payment the day of delivery and by Monday morning she stopped payment. She even added (last minute) 3 dozen red velvet mini cup cakes with fondant OU's and 2 dozen banana nut mini cup cakes and never paid for those or even offered to pay. I even took a week off from teaching to get every thing done for her.

At the reception hall, I waited for about 30 minutes to get the final payment and then had to go hunt her down to get it. I wasn't leaving with out it-I just had that weird feeling. I kind of felt it when they stood me up for the 1st tasting and then was late to the second tasting. I was prepared to take the cake with me, if I didn't get the check. I did get it, but it didn't to matter.

She hired the flowers out to a florist-no problem. However, she told me if it were not for the flowers it would have just been awful. Duh! The flowers ARE the decoration!

I told her she was steeling from me and taking away from my children. Had she been honest and forth coming, I would have gladly refunded a portion of the money.

So, would you consider this cake a disaster? To stop payment? I think she was being ridiculous, but that's simply my opinion.

It is totallly illegal ( and I'm sure in just about every state) to accept goods & then immediatley stop payment on a check. But my question to YOU is, what do you mean she ordered extra stuff and didn't offer nor did she pay for them? Why would you then do them? If someone orders extra stuff or changes ANYTHING my response is "And that will cost you x,y, &z?"! Oh yeah, take her to court!

It's a beautiful cake.

She shouldn't have stopped payment. Can you call the police and report her for theft of services? (I don't know if that works for this situation, maybe someone with more experience will know).

After this, if you're taking payment the day of, you should only accept cash. Otherwise, ask for a check early enough that it clears before the wedding.

I know stop payments have been discussed on other threads, but being married to a former 25 year upper mgmt banker, I can tell you that there are rules and laws that apply to what can and can't be used for stop payment reasons. Example that hubby ran into a couple of times when he was a collector...... customer pays with check, then customer issues a stop payment on the check. No can do, babycakes. That's fraud. If you order something, receive it, and stop payment on it just because. no can do, babycakes, that's theft by check deception.

I'm sharing what I know just via conversation and I hope a CC'er banker pops in here with current knowledge for you.

Of COURSE it would look plain without the flowers! As you said, "DUH!!!"" Did she say specifically what the problem was? On the surface, I think you have a theft-by-check-deception case. I'd call a lawyer or the prosecutor.

I don't know what part of the world you're in but I'd do some checking I think mob might be in deep doodoo for this. Each state is different so do some checking--start with a local attorney if you know one or call your state attorney's office.

You can't do stuff like that. She received merchandise -- she is perpetrating fraud- no kidding.

Your cake is beautiful! I'm not sure why she stopped payment, but will watch. I'm curious too how someone can stop payment 'just because'.

The workmanship on your cake is rock solid firmly well above average. Those hex's are a huge pia and then with unforgiving ribbon trim? The picture is looking flawless--those are extremely difficult to get looking like that. You don't even have any piping to help cover up flaws. Bare naked cakes are tough to do that well. Bare naked hexagons are ever the more difficult~

Mob's got big problems!

Yep, that's check fraud. I'd be going right to the DA's office. Most have a bogus check division and I'd be filing charges against her.

Unless she lied about it at the bank I wonder how she got it all past the bank huh? You have to give a reason why you're stopping payment--the bank should have advised her she was jumping off the ledge if she told the truth in the first place.

Now:

No payments ever ever ever EVER day before, day of, 20 minutes before, even 3 days ahead. Ever. Unless it's cash and even then you're crazy to deliver cake not fully paid. This is what happens. Dang....that is unfortunate for you.

I wish Bank of America would make people do that Kate. I bet a lot fewer "stop payments" would be issued if people actually had to go in to the branch and sign a paper. It's much too easy to do it through the automated line and they only charge you a $10 fee.

I bank with USAA and it's all automated too. I tried to call and put a stop payment on a stolen check before and they asked me like four times if I wanted to hang up and do it online (and guess what I told them! icon_lol.gif ).

I wonder if she did that with all the other wedding vendors too.

yep! and the cake looks nice to me.

From being on this site, you all have really opened my eyes to how silly people are! I really would never imagine that people like to play games like this about a cake that they know they couldn't afford in the first place. this is so silly! i can tell I'm gonna have many-an-interesting-day when I begin caking seriously. Lawd give me the strength to not flip out on people about my $$ icon_twisted.gif

It sounds like the the MOB wasn't so sure about the details. Was it in the contract that an outside florist will place fresh flowers on the cake? With out a doubt the MOB is in the wrong! I wonder if a better contract would be helpful in avoiding this in the future.

And what was the florist smoking? Sticking callas stems right into the cake!!!? Poisonous??? AND- Look at the one that is just above the bottom boarder on the top tier. Ya that one right in the middle is not even placed nicely, just sticking out! LOL

I'm still trying to figure out what was wrong with this cake. Did I miss something?? Am I a dunce? It looks great to me unless there was something very specific left off or not done as agreed. Flowers shouldn't be your concern, unless like Sad mentions, they do something boneheaded like that....might as well have squeezed some hydrangea juice over it for extra flavor! icon_cool.gif . Ok. here is my 2 cents. My contract states that 50% is due at the booking (as they are signing the contract they are handing me a cheque), and the other 50% is due 30 days before the event. Yes, I said it... 30 days!!!! That way I know for a fact that the cheque is good. I have never had one bounce or cancel. I also have had a couple of people back down when I explain what my policy is over the phone. AND if they cancel after the booking but prior to the 30 days, they completely lose their deposit.

Good luck, and I hope that the bank works it all out for you in the end.
