I think that you can only cash a check and walk away with the money if you do it at the bank it's written from or your own bank.

If it's cashed at the bank it was written from, that's the end of the story. You keep the money; it comes out of her account.

In my experience, if you cash it at your own bank, it's usually done with your own account as collateral in case it bounces or is stop payed. If so, they take it out of your account.

bet the bride isone of those ppl who buys an expensive dress, wears it and then returns it. I used to work in high end retail, it happens all the time.

Exactly...that's the way it has always been explained to me. If I want to cash a check at my bank, they want my account # on it and ID from me. Like you said, if you went to their bank, you'd be good to go. I had to do that once with a bride whose final payment got "lost in the mail". She gave me another check just days before the wedding and I went straight to her bank and cashed that bad boy!
This is better than a soap opera, I've been tuning in since page 1...luckily I already got my cakes done for the week! lol

This bride is unbelievable. I'm also from AR and southern belles should not act this way.

Unless the bride does not pay for the cake and then the gloves come off!!!!!

Wow, that had me upset.....thought maybe somehow I had sleept thru a whole 36 hours and didn't know it. Knew that wasn't possible because I really didn't 'sleep' just rested w/some snatches of catnapping icon_smile.gif

Ok, I work in the banking industry. Here's my problem with the whole situation. If both parties bank at the same financial insitution and the OP was paid on Monday, it does not matter when she deposited the check into her account. The funds would have been deducted from the BTB's account on the same day as the deposit. WHY is the bank allowing the customer to place a stop payment on a check that has already been paid? If the BTB called after the check was deposited ( which it sound like she did ) and stated to the bank that she had a dispute with the vendor, there's nothing the bank can do about it. The check has already been paid. The bank should have said that she's going to have to pursue other means of getting her funds from the OP, meaning she's going to have to take the OP to Small Claims Court.

I think we are all waiting in suspense to see what the bride says!!! I am glued to my computer and hitting refresh constantly!!!!! People that think like this definitely have a problem... and how sad is that.... I mean.. it's not like the check bounced... she willingfully and knowingly stopped payment on a service provided.... what kind of people are we today anyway??? GUUUURRRRR

And OP- I don't know if you can do this in your state or not, but if so, I would post a copy of the Stop Payment in the window of my shop (just remember to redact her account #) to let other customers know what REALLY happened when they hear the rumors about what happened (because you know there will be rumors.)

that is actually true for business checks. Well, incorporated business, I know for sure. My husband and I own a trucking company and we had someone bounce two LARGE checks to us. When we finally got the legal copy in the mail, his bank would not cash them. They explained that it is a gov. law, so you can't hide business income, tax reasons. So, we are going to open another business checking account at his bank and deposit it there, that way, we know the funds will clear if they run it through.

I too, am waiting in suspense to see what happens....I still like the idea of framing a nice, large picture of the cake next to a framed copy of the stop payment letter and setting that out at the venue!

I worked at a bank for several years and this was our policy also. If the check already cleared you are SOL. I don't understand why they would issue a stop payment several days later. Most banks process over night and since they both use the same bank the funds should have been transferred the night it was deposited. This really has me stumped. icon_confused.gif

After reading through everything, this is one to contact the D.A. office on because it not only shows intent, it's Theft Of Services and Check Fraud...

Even if you're "in" with the reception site and it is 35 minutes away, I'd still deliver the "canceled check" paperwork to the site myself.

Ugh... The worst I've ever had was arriving home from delivering a cake to a posh wedding site and getting home after delivering the most elegant cake I've ever made to the NSF envelope. Thankfully they made good on it when they returned from the honeymoon, but it was still a PITA... That was the first and last time I'll accept a check 14 days out, it takes some banks about 21 days to get NSF checks processed through and that's a lot of checks in and out in that amount of time. Thankfully I had enough in my other account to shift funds, but it still was a PITA...

Personally I liked the idea of cutting the cake in half because she had paid for half. But that would mess up the looks of the cake if you were going to donate the rest of the cake somewhere.
I sure hope this works out for you (OP) what a stressful situation to be in! It does seem strange that she wants the cake and will try to come up with the cash. You have to go to a fair amount of trouble to stop a check,. you can't exactly do it by mistake.

I cash business checks for cash at the different banks that they were drawn on-- maybe like just in the thousands not tens of thousands though.

She said the wedding starts at 6pm (7pm EST). She was to deliver around 4:30pm (5:30 EST).

Hour and a half until delivery time...

I too am confused about the bank "recalling" back the money from the OP's account.

Even though the OP and Bride bank at the same bank, once the money is taken out of the bride's acct and placed in the OP's that transaction is complete. To me the bank is wrong to then turn around and remove the money from the OP's acct just because the bride issued a "stop payment".

Something fishy going on with this situation. I deal with about 100 personal checks a week at my Salon.........I've never seen this happen in all my years in business.

I'm curious to find out the end result too. It sounds like the bank screwed up. You can't stop payment on a check that has already cleared. Even if it is all at the same bank. Since it happened though this bride is in serious trouble if she doesn't pay up in cash. If she pays up I'd leave it be, but if she doesn't I would definitely file a police report and sue her.
