Hi, I was wondering if anyone has any knowladge on the laws for home cake making in NC. Would REALLY app. any type of advice thanks so much ... first day on the site icon_biggrin.gif

Apparently, North Carolina home baking is licensed by the state department of agriculture. A search in the business forum produced this link.

Okay...I've been REALLY freaked out about this, so I finally called around and got some info:

I spoke with Anita at the NC Dept of Agriculture (919) 733-7366. She was VERY nice. She said that to be legal for the State of North Carolina you have these basic rules:
1. NO pets
2. NO infestation of ANY kind
3. A one-time inspection is done with an appointment and you get a piece of paper stating that you have been inspected by the NC Dept of Ag. Unless there are any complaints on you, you will not be inspected again
4. You can use your own kitchen and equipment
5. City water is fine (I didn't get any info in case you have a well)
6. No dust collectors in the kitchen. She said that paintings are fine, but no plants or dried flower arrangements that can collect dust. I asked about my Coca-Cola collection on the walls and cabinets and she said that the inspector would use his own discretion in whether or not they would need to be removed. They would just tell you to remove the items and unless it was a major problem, there would be no re-inspection.
7. You CAN sell WITHOUT an INSPECTION to friends, family, co-workers and any word-of-mouth customers for money. You just CANNOT sell to the general public by way of ANY advertising. She said that this means: NO business cards, NO church fliers, NO radio ads, NO advertising of ANY kind.

Also,
I called the City of Fayetteville Licensing Department (910) 433-1676 and they said that I needed to get a permit from Sharlisa Davis at the Cumberland County Department of Environmental Health (910)433-3693 and then provide a copy of that permit to the City of Fayetteville Licensing Department. The fee is $50.00 and I get a privilege license that is renewable every year. I still have to get these details worked out on the City and County level, but I'm waiting for returned calls to come in.

I still have to find out if I need a tax ID, etc. I'll post when I have more information to help out any fellow NCers!

Derby, Do I understand you right?

As long as you DO NOT advertise, you CAN SELL to people you know, WITHOUT an inspection.

How does this affect if someone would complain on you about something?

you read correctly. She said that you CAN sell to people you know, without an inspection. You are always subject to problems if you have a complaint. You just cannot sell to the general public and you cannot advertise in ANY way. She made that VERY clear!

Keep in mind....her information is just for the North Carolina Dept of Agriculture. This does NOT consider any county, city, or township/district laws or regulations in your specific area.

I know this is an old post...and I haven’t yet delved into any of the other umpteen many other posts...all tabbed on my computer until dinners done and the kids are in bed lol. But does anyone know or have insight on mecklenburg county? Definitely not ready and don’t think I’m (honestly) good enough to sell cakes-definitely not fondant cakeslol-or other goodies just yet. But DHs coworker was asking how much I’d charge for a cake the other day (when I sent him in with leftovers to work so they wouldn’t go bad). So it got me thinking about all the rules and regulations. We have indoor pets-a dog and a cat-so definitely NOT ready. Just pondering.
