At a salon they have magazines (as do I at my studio) but I don't claim to have made all the cakes in them!

Do people think that just because I am in many hours drive from her (and others) that no one will notice?

If you don't have a portfolio than you should make cakes until you do. Make them for every family occasion, don't steal!

It's ridiculous that brides are mislead that way, seeing a perfect cake but who knows if the person will be able to deliver!

Her apology is a joke. The truth of the matter is is that she took those pictures and posted them to deceive people. Her big trouble was that its a small world and she got caught. A shame.

I'll play devils advocate. I've seen several threads like this and everyone is quick to judge and say the accused is a horrible, deceitful, rotten person. But then the person is shamed and upset and quick to apologize and we realize she's not as bad as we made her out to be. I think we should be a little nicer about it rather than publicly humiliate her. Sometimes we get like a beehive and attack. It's kind of funny actually. icon_lol.gif She may not have known it was offensive or several other reasons. She seems as though she's trying to fix it. I have a feeling this will be like other cases and we'll feel bad that we were quick to gang up on her. So be careful not to get too riled up. You may regret it later.

I was just looking at her sight. She still has some that aren't hers! One that stands out to me is the Thank You Teacher cake. That was made by cc member cakesbysam. I have it in my favorites. I could understand if she copied a cake idea, but it is sam's picture. The stolen photo is kind of scrambled but if you look close you can make out the names of the teachers...same as Sam's!!! I sure hope this person was not someone posting on cc and pretending to be our friend, that's just spiteful and mean!!!

this has been added to the apology, since it wasn't there the first time i read it:

what i don't understand is that if there was a file that had a jumble of different pictures, how did the publisher know which heading to put the photo into, unless they discussed it with her first.

also: how did the watermarks get removed, and pictures renamed if a faceless, "for hire" person was responsible?

also: if and when i get a website, you can bet that i'm gonna be on it as soon as it's finished, because i'll be so happy and proud to look at it...you can bet that i'm gonna notice something wrong right away and correct it immediately.

It's deja vu. It sems like about six months ago or so, that someone else did the exact same thing on her site, and when confronted, she gave almost the exact same excuse...photos on disc, blah blah, given to her by brides-to-be blah blah, downloaded by accident blah blah... icon_confused.gif

Does anyone else remember that incident?

Sorry. I just can't believe she did this not thinking it would offend someone. She is only trying to fix it because she got caught. My take on it is that she is not sorry she did it, only sorry she got caught. JMHO You just don't take credit for someone else's hard work.

As much as I hate to say it I think this is pretty common practice for some people. They have no cake portfolio and use other's cakes on their websites. The bad thing is when some1 orders one they won't be getting near the quality the expect. There is a lady in my town with a website and she has mayb 3 cakes that are hers and all the others are pro cakes....u can tell by the picture quality and style of decorating which are hers. Its sad but I think it happens alot.

I have to admit. When I see a cake on here that I would love to replicate I print it off of here and put it in my wish list cake book. Then I have a cake book of my own. So later I can go back and look and say...Well I should of done this or that...but lately the idea's have been flowing ok for me so I don't try to replicate peoples cakes very often. But I still love to print them just to look at them and wish. I hope that doesn't rank as high as this person trying to sell people on other peoples cakes icon_sad.gif that would make me so sad.

I think this lady is wrong for allowing this to happen (not checking the website before it was made available to all). But it seems like she is being torn apart for what could have been an honest mistake or just a really bad judgment call. I am not sure that someone would knowingly try and post say a Duff cake on their website as their own. It seems rather absurd and what would make me think that it was a mistake.
Also the cakes on her site that legitimately look like hers are pretty good and I don't think she would need to falsely represent cakes that aren't hers.

Wow, this thread has really multiplied since the last time I looked......here are some things in the back of my mind:
1) Having worked in the web publishing business myself, you usually have the person that requests you to publish approve before going "live", but that doesn't mean that she reviewed everything (like photos, for example), before approving it.
2) If she has a publisher, typically, they advertise at the bottom of the home page or contact page with something like "this website created and maintained by .............."
3) I think that all people can make an honest mistake.
4) We can all be a little harsh to judge.

Given these things, I think we should all keep an eye on the site to see if it happens again, and if things don't get cleaned up, then people who have had their photos used without the permission should do what they feel is the best to take care of the problem. I was not personally affected by this (I only wish I were good enough to have someone want to steal my photos icon_wink.gif ), but I can imagine the anger that those of you who had theirs used on her site are feeling.............so, let's see where the website goes from here. icon_smile.gif

I can totally see someone not realizing or understanding it was wrong, or just not thinking about it. They may have done a cake like it before, but their photo turned out poorly or some such and decided that they'd make their cake gallery an idea book or something and just not think. It is great she is taking down the pictures so quickly, very responsible. I just had trouble seeing how the inclusion of the pictures was inadvertent. The offense, the hurt feelings, etc, those all could be inadvertent. But the actual inclusion of the pictures? But as it won't harm me at all to believe it was a mistake as she says it is, I'll take it as such.

That is one of the issues with this site. There is no way to protect your pictures. I recommend that anyone who wants to protect their pictures to put a copyright directly on them. I always sign my cakes before posting my pictures on CC for this very reason. I also sign my cakes on my personal website. I don't want anyone to "steal" my pictures but when they use them for inspiration, at least they know who's picture it is because of my signature.

ok..heres an interesting thought...here me out...
IF..and I mean IF the accidental CD was included...dont you think that as soon as someone mentioned that it was their cake and not hers..would common sense not tell you to go look at your website and at that point would you not be able to go "oh crap-thats not my cake-hm...let me take it off here so i dont piss off others?!" i figured i would notice so why shouldnt other people?! icon_smile.gif not that this effected me at all..but i would be disgruntled if i went to all that work to create something and then somone took credit for it...not to mention she has at least 2 cakes from Walmart on there as well..and the 4 strawberry ones on the grooms page are from a page of a CC member that I looked at recently...it may have been cali4dawn or customcakesbysharon....i know i have looked at their pages recently...

Don't shoot me for this... I understand that she took other people actual photos and had them put on her site. I get that...

BUT what if she just duplicated the cake? I know that I have seen some awesome cakes on here and wished that I could duplicate them. I have seen other cakes that are similar to what I would like to do, and so I took a little of this and a little of that... FOR EXAMPLE... my spidey cake. I knew I was going to put spidey on top of a building and I saw someone else who had done that. I added the idea of the green grass and the black ooze, and my building was modeling chocolate. Tomorrow I am making a cake from a book of directions. Now, I will post the pic and say...this is my version of the cake in so and so's book... but I am changing enough of the design so that it is not a direct copy.

Does that make sense. I am not defending stealing someone else's photos, or claiming their cakes as originals, but I know that we have all used this site for inspiration at one time or another. (spidey busts anyone???)

Don't hate me, but I am feeling compelled to say... maybe we shouldn't throw stones.

YES IT CAN HAPPEN!!!!!

The person who design my old website, did just that. he came over and downloaded all the photos I had on my computer..Once he was finish with the web page, thats when I notice, another person pic on my website. Of course it didn't stay long, but it can happen...and I would have felt really bad, if that person who have saw the pic, because, I did not or would not every post someone pic, on my site if I didnt do the cake. She apologize, so can we please stop bashing her.. Im sure she is sitting here reading what people are saying about her. Everyone has feelings...Tina
