Hi Everyone
I have a question about selling and advertising cake with cartoon characters. Is it unlawfful to advertise cakes with disney or movie characters or not. I've notice on some websites they somethimes say that they can not sell cakes with character. If any one has the answer to this question I have order from decopac and bakery crafts and purchase items at the local stores. If any one has the answer to this question please let me know the answer asap. thanks a million in advance.

The only way you can sell them is if you purchase either the licensed kit or edible image. You can get them from decopac. I get them in a pinch at my local grocery store but the edible image alone there costs $8.95
You can also order them from thepartyworks.com and a few other cake decorating sites.
You can add purchased items like images or toys, but you cannot create the image unless you have paid for the license.
You can't sell cakes from character pans, or make transfers of those character/images.
If you advertise those images, they can fine you huge dollars.
Exactly as they've stated above. don't assume because other people are doing it that they are doing it legally or correctly.
So, when I've gotten an order for say, a Scooby cake--and I've sold it to Jane Doe--that's illegal?

What about an edible image? What makes that legal?
They have to be licensed to be legal. The makers of licensed edible images have received permission from and paid royalties to the copyright owner in exchange for using the image.
Be very, very careful about this, because Disney and other owners of licensed characters don't mess around when it comes to protecting their copyright.
They won't hesitiate to sue anyone who uses their images illegally.
Companies invest a LOT of money into their imaging, especially ones involving characters. They have specific rules regarding using them. HJave you ever tried to rent a popular cartoon character's costume? It comes with a strick set of instructions you have to follow, if you can get one at all.
It is not only limited to cartoons though, Apple, Microsoft all do the same in regards to their logo and artwork. You will get the nasty legal letter. They have people who scan the internet and public advertising venues looking for misuse of their identity and corporate imaging.
