Most likely it would require a commercial kitchen, so that you meet all the health requirements of the destination of your goods. You health licensing entity could probably tell you.
There are no federal standards. You need to be licensed in the state which you produce your goods. All standard regs apply.
Sooooo the people selling on Ebay have licenses? What do ya think? Are the rules different for Ebay? I'm only asking out of curiosity.

It is doubtful they they have licenses, but possible. But just because it's illegal doesn't stop them from doing it.
I would think just your own state's licensing requirements would apply, not where you are shipping. I think it would be impossible to comply to all of the different rules and regulations that each state seems to have.
Who buys cakes off of Ebay. I'm sorry but that kinda grosses me out. It wouldn't be fresh. You have no idea who prepared it, and where they prepared it. My 2cents...
You would need to have a license in the city that you do your bookkeeping from. For example, I had an internet business for a while and had to have a business license for the city where I paid my bills from and then have a resale license in that state (CA). The internet doesn't remove any of the restrictions of commercial kitchens, taxes, etc. As far as ebay, I would guess they are only trying to sell to people in their area and using ebay as a marketing tool. I can't imagine that they are trying to ship the cakes.
