I love the name Sweet Emotions for the name of my business but it's the title of a song. Does that matter? What do you think?
I don't know if you could use that name or if it would be protected. Sorry I can't be of help!
I would go speak with an attorney that specialized in Copyright--they can probably tell you in under 20 minutes of work, and if you can find one through a small business association, they would probably be able to do it for very little money or even free (shhh, dont tell my fellow attorneys that I mentioned that word!)
Unfortunately, I dont have any backround in copyright, so I cant help--but I can tell you that there are certain phrases that are for the "public use" and they just cant be protected--I have no idea if "Sweet Emotions" meets those qualifications
In any case, figuring it out beforehand, even if you have to pay an attorney a little bit, is much better than guessing wrong and being sued later!

I think it would be more an issue of trademark rather than copyright. Trademarks would be more along the lines of brand names, symbols, logos etc. Whereas, copyrights would have more to so with intellectual property.
Oh, I forgot to mention. When you are applying for patents, copyrights, trademarks etc. You do not want to advertise what it is you are trying to protect. Especially not on the internet. I know it may seem a bit anal but it's i your best interest to keep that information private until you have all the insa and outs taken care of. You dot want your ideas being stolen from right under your nose. Once it's out there's no way of protectiing it.
I just looking this up. Here is some reading to get you started.
