I have a contract that I use for my retail wedding cake customers, but I've recently been getting some interest regarding setting up wholesale accounts with restaurants and catering companies for wedding cakes. I evaluated my current contract and it just doesn't seem appropriate to use for wholesale clients. I'm wondering if any of you have two types of contracts, or do you not use a contract when doing wholesale orders? I'm not even sure if I need a contract for wholesale orders because the bride would have a contract with the restaurant, and therefore not technically ordering from me. Sorry to be so rambly!

I would think that you definitely would need a contract with your wholesalers. If for no other reason than to secure how much they are to pay you and what you are to provide....in order to hold them liable if they fall through on their end of the deal. Maybe this could be just a general contract that you sign initially with your wholesaler to secure the 'partenership' deal - in other words, the agreement that they are hiring you to make custom cakes and what your basic financial terms, their & your responsibilities, expectations, etc. are concerning that...then have signed purchase orders or something along those lines for each cake ordered...with all of the specs for the cake listed and amount you are charging the wholesaler? I'm assuming this is for catering companies that want to hire you to do the cakes for the weddings they are catering?? If it's just for general baked goods, as well as custom wedding cakes, I would still say you need a contract, but separate ones for the general baked goods, and another for the cakes end of it. I hope I read your post right & this info is helpful icon_redface.gificon_smile.gif
