Question for CakeManOH: What does your contract say about natural disasters? I live in Houston, so we often have floods, hurricanes, etc. What if the stubborn couple decides to go ahead but my company can't get the cake to them (without endangering the driver in high water)? Should I offer a full refund if I've already made the cake?

You may want to add an addendum...

After delivering and setting up and leaving cake(s) in order. Finding no faults with setting up and leaving cake(s) in hands of

client, no refunds are given in event of cake being touched or destroyed by running and playing children, teens, adults, caterers,

pets, loud music, natural disasters, unlevel floors, moving of furniture, bumped tables resulting in loss of cake, unruly dancing,

champagne corks, sprinkler systems, hot/cold weather, falling ceiling tiles, ceiling fans, window dressings, or persons that dont

know how to disassemble cake for serving.
I no longer will be held responsible of the cake after delivery. Any last minute decisions of moving the cake to another location or

table shall be the clients responsibility.

YES!!!!

Some jerk thought slam dancing was cool. Nearly took out an elderly gentleman and his date at a friends wedding.

He finally moved on out to the patio and the last I saw of him he was on the tennis court shooting tennis balls at kids on the golf course with one of the clubs tennis ball machines.

I added this in another forum and an unhappy customer about serving sizes...

"Cake servings sizes are estimated. Specialty cakes, carved cakes, method of slicing, and preparation may affect ultimate serving sizes. Customer understands and accepts these terms, and has order their products accordingly after having considered these variables."

Has anyone used this with their clients yet? Has anyone expressed concern or surprise at all the things that they are responsible for? e.g. the fine print...

Are there any strategies for speaking to your clients reassuring them that the contract is to protect both parties...

I've just found that the best way to deal with clients is to be right up front with them. No surprises. That way they can't say "I didn't know..." or "You never said..." when it's all spelled out both verbally and in writing. icon_twisted.gif

On the section about cancellations, you say that after two weeks you can't accept cancellations, but what if someone cancels then still expects you to make the cake? I'd just reword or clarify that, since they might want you to make the cake anyway or not, and your idea of a cancellation is that the cake won't be made. (That's what mine would be)

I just rewrote my contract and ended up adding another page to it (it's 4 pages long with a lot of specifics), and I tell people that I think that everything they have qeustions about should be covered in there. I haven't had anyone complain about how strict it is, and I've had at least 4 or 5 bookings since I started using the new format, so I don't think a long contract will affect anyone's decision to book or not. If you present it as "this contract is pretty thorough, and I think that it will answer anything you could think of asking," then people won't question it.

I also have a feeling that even though my contract is fairly strict, most reception venues and other vendors have stricter ones, so it isn't something people haven't seen before! icon_rolleyes.gif
